These Terms of Service ("Terms") constitute a legally binding agreement between you and Aleksander Kowalczyk ("we", "us", "our") governing your use of the TickTappy application ("App") and related services. By downloading, installing, or using the App, you agree to be bound by these Terms.
1) Acceptance of Terms
By accessing or using TickTappy, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use this App. By using the App, you represent that you meet this age requirement.
2) License Grant (EULA)
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial purposes.
Restrictions
You may not:
•
Copy, modify, or distribute the App or any portion thereof
•
Reverse engineer, decompile, or disassemble the App
•
Remove or alter any proprietary notices or labels
•
Use the App for any unlawful purpose or in violation of any laws
•
Attempt to gain unauthorized access to our systems or networks
•
Use the App to transmit malware, spam, or harmful content
•
Sublicense, rent, lease, or lend the App to third parties
3) Subscriptions and Payments
Free and Premium Features
TickTappy offers both free features and optional paid subscription plans ("Premium"). Free features are available without payment. Premium features require an active subscription.
Subscription Plans
Premium subscriptions are offered on a monthly or yearly basis. Pricing is displayed in the App before purchase. Prices may vary by region and are subject to change.
Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your payment method will be charged for the renewal within 24 hours prior to the end of the current period.
How to Cancel
You can cancel your subscription at any time through your device's subscription management settings:

iOS/macOS: Settings → Apple ID → Subscriptions → TickTappy → Cancel Subscription
•
Android: Google Play Store → Menu → Subscriptions → TickTappy → Cancel
•
Web: Through your account settings or by contacting support
Cancellation takes effect at the end of your current billing period. You will retain access to Premium features until then.
Refund Policy
Refunds are handled by the respective app store or payment provider according to their policies. We do not process refunds directly. For refund requests:

Price Changes
We may change subscription prices at any time. Price changes will not affect your current billing period. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.
4) User Accounts
You may use TickTappy without creating an account (offline mode). If you create an account to use cloud features:

You are responsible for maintaining the confidentiality of your account credentials
•
You are responsible for all activities under your account
•
You must provide accurate and complete information
•
You must notify us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms.
5) User Responsibilities
You agree to use TickTappy responsibly and lawfully. You are solely responsible for the content you create and store in the App (tags, time entries, etc.).
Prohibited Conduct
You may not use the App to:
•
Violate any applicable laws or regulations
•
Infringe on the rights of others
•
Attempt to interfere with or disrupt the App or servers
•
Circumvent security features or access restrictions
•
Use automated systems to access the App without permission
•
Engage in any activity that could harm us or other users
6) Intellectual Property
TickTappy, including its design, features, content, and code, is owned by Aleksander Kowalczyk and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.
You retain ownership of any content you create within the App. By using cloud features, you grant us a limited license to store and process your content solely to provide the service.
7) Third-Party Services
The App may integrate with third-party services (e.g., Apple App Store, Google Play, payment processors, analytics providers). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
8) Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the App at your own risk.
9) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability will be limited to the fullest extent permitted by applicable law.
10) Indemnification
You agree to indemnify, defend, and hold harmless Aleksander Kowalczyk from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.
11) Termination
You may stop using the App at any time. We may suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms.
Upon termination, your license to use the App ends immediately. Provisions that by their nature should survive termination will survive (including disclaimers, limitations of liability, and indemnification).
12) Account Deletion
You may delete your account at any time through the App settings. Account deletion will permanently remove your cloud data. Note that:
•
Deletion is permanent and cannot be undone
•
Subscriptions are not automatically cancelled; you must cancel separately
•
Local data on your device is not affected by account deletion
13) Modifications to Terms
We may modify these Terms at any time. We will update the "Last updated" date above and may notify you of material changes through the App or email. Your continued use of the App after changes constitutes acceptance of the modified Terms.
14) Governing Law
These Terms are governed by the laws of Poland, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved in the courts of Poland.
15) General Provisions
•
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
•
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
•
Waiver: Our failure to enforce any right or provision does not constitute a waiver.
•
Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
